CORRECTION

1. For this incident, calling government hotline 1823 is WRONG
and causing UN-NECESSARY workload to both 1823 call center and the police.

This incident is believed to be a criminal case (Obtaining property
by deception / Theft) and this is the duty of the Police to tackle criminal
cases, if tele-conversation is really needed, call police hotline (852)25277177
directly.

2. At this stage, email contact is enough and I believe the officers of
the CRB IT team will reply to Resluchub for further investigation soon.

P.S. I am just a passer-by, but I believe my knowledge and experience
of handling this kind of cases are much much better than other users here.

If possible, please try to inform every victims (who had ever traded with the suspect)
around the world and invite them to contact to the Hong Kong Police as soon as possible.

More information provide to the officers, will make their investigation easier,
as a result, more likely to send the wrong-doer to face the prosecution at court.

But please be reminded that, as it's difficult to prosecute without witness / victims,
therefore victims maybe request / invite by the police to come to HK and attend the
law court as witness (usually on their own cost), so please be prepared.

會,如果證明物主並非疑人的話,仲會物歸原主添。 而你最多係透過民事索償向疑人索賠。

而同疑人買野既人 (即係新買家),如果被證明係購買之時明知係贓物仍然購買的話,
則有干犯「處理贓物罪」之虞。

Yes, if the item sold was proof not belong to the seller,
then the item maybe return to the original owner (if found).
And you can only sue the seller thro' civil procedure.

In addition, if the new buyer was proof known the item was stolen items,
then he/she maybe committing "Handling stolen goods" (Cap.210, S.24)

今又唔可以咁講,
一日法庭未定罪,咁佢都係無罪嘛。

(1)可能未查完;
(2)可能證據不足;
(3)可能查無此事;
(4)可能證人拒絕作供 / 拒絕指證;

有一千個可能性呢...

但如果未經定罪大家就已經「網上公審」左呢位仁兄的話,
其實亦唔係太公平,分分鐘仲可能被人指稱毀謗,咁就無癮啦...

不如等當事人一干人等自行透過警方處理啦。

係可能性之一囉...
始終刑事案既判決既standard of proof 要「Beyond reasonable doubt」,
老老實實,刑事案件如果售害人唔出庭的話 (除左謀殺啦...),
要說服老爺去將疑犯入罪係有一定既難度既。

相反,如果受害人千里紹紹都肯自費黎作證的話,
對法庭既考量又會加左分。

以上,純粹個人就一般法庭案件之觀察及意見,
不代表任何部門、單位、團體立場,亦非討論特定案件。
